Advertising spend is separate from agency fees and the client is responsible for platform budgets. We may use Google Ads, Meta, website hosting and analytics tools.
We are not liable for platform changes or outages, account suspensions or performance fluctuations.
9. Intellectual property
Website branding, text and design are owned by ELK Partners. Client deliverables may be used by the client after full payment.
ELK Partners retains ownership of strategy frameworks, processes, methodologies and results data. We reserve the right to showcase work for portfolio and marketing purposes.
10. Confidentiality
Both parties agree to keep confidential information private and not disclose it without consent.
11. Data protection and privacy
We process personal data in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018. Refer to our Privacy Policy for more information.

Agreements run for the agreed duration. Either party may terminate with 30 days’ written notice. We may terminate immediately if payment terms are breached or unlawful or inappropriate activity occurs.
15. Non-solicitation
Clients may not directly engage ELK Partners team members or contractors during the agreement and for six months after termination without written consent.
16. Website accuracy
We aim to keep website content accurate but do not guarantee completeness or reliability at all times. Content may change without notice.
17. Force majeure
We are not liable for delays or failure caused by events beyond our control, including technical failures, platform outages or external disruption.
18. Governing law
